Transfer of Seat to Walton County, and Reassignment of Magistrate Inere to Escambia County (vacating 2019-36 and 2019-45) WHEREAS, pursuant to Rule 2.215(b)(3), Florida Rules of General Practice and Judicial Administration, the undersigned Chief Judge has the authority to establish case management strategies for the efficiency of docket control, and WHEREAS, pursuant to Rule 2.215(b)(4), Florida Rules of General Practice and Judicial Administration, the Chief Judge shall assign judges to the courts and divisions, and shall determine the length of each assignment, and WHEREAS, the Honorable Gary L. • Bergosh has announced his retirement from the bench, effective September 22, 2024, and WHEREAS, due to the significant need for judicial resources in Walton County, it has been determined that the judicial seat vacated by Judge Bergosh should be transferred to Walton County, and WHEREAS, those matters currently assigned to Judge Bergosh in Division M must be reassigned to other divisions, IT IS, hereby, ORDERED: 1. • Effective November 1, 2024, Escambia County Family Law Division M shall cease operation, and the Escambia County Clerk of Court shall reassign on an alternating basis all currently open matters pending in Division M to either Division L or Division P. • All matters currently pending before the magistrate in Division YM shall be reassigned to Division YP. -- 1 court judge shall preside in Division DV on a rotating basis for coverage of the entire Division DV. • Juvenile judges from Divisions G and H shall also serve in the general rotation for the purposes of the DV duty calendar. 8. • During any week a county judge or circuit judge is assigned to consider petitions for injunctions, the assigned judge must be available to consider the petitions presented by the Clerk of Court during normal business hours. • Petitions for injunctions against dating violence, repeat violence, domestic violence, sexual violence, and stalking shall be assigned to each division as is appropriate in the division’s duty week. • If for any reason the judge assigned to consider petitions is not available, the assigned judge or her/his judicial assistant must make coverage arrangements for incoming petitions and notify the Clerk of Court’s Family Law department staff regarding which judge will review petitions in the assigned judge’s absence. 9. • If upon the filing of a new family law case it is found by the Clerk of Court to be related to a domestic violence case assigned to Divisions DV, G, or H, the Clerk shall assign the newly filed case to the appropriate judge as outlined in paragraphs 2-4.
