Verbatim from Fourth Circuit administrative order 09-01 as published by the Duval County Clerk, harvested 2026-07-26; whitespace normalised only. • The Court uses a combination of stenographic and digital recording methods to capture the recording in all judicial proceedings where court reporting is required at public expense. • These managers shall implement policies and procedures for contract court reporting services and digital court reporting. • A qualified court employee who shall ensure the digital recording equipment will reliably provide for recording of the proceedings and whose duties include operating digital recording equipment in the courtrooms and hearing rooms in the Fourth • A transcription of the proceedings, all participants shall pronounce words clearly; avoid cross- talking; and spell names, technical tenns, geographical locations, and case citations. 2 -- 2 of 7 -- • If a proceeding is confidential, t\he transcript or audio recording shall be provided only to those persons authorized by law or those persons who obtain a court order according to applicable statutory provisions. • Court while acting as court reporters in a judicial proceeding._As an officer of the Court, the court reporters shall comply with all rules and Florida Statutes goveming the proceedings that apply to court reporting. • Rates for reporting and transcription services of court proceedings shall be as set forth in the current court reporting contract, including any amendments to the contract. • Judicial proceedings reported at public expense by stenographic court reporters that take place in open court between the judge (including magistrates and hearing officers) and the lawyers/parties shall be reported as set out in the current court reporting contract and any amendments to the contract. • The State Attomey’s Office shall advise the presiding judge twenty-four (24) hours in advance that a contract court reporter capable of providing real-time services is needed to report the proceedings. • The contract court reporting service shall ensure availability and supply only court reporters who have the capacity to provide real-time transcription for,all trials in which, the State seeks the death penalty and in all capital postconviction proceedings. 3 -- 3 of 7 -- \ • The contract court reporting service shall prioritize capital case transcript production to complete these transcripts expeditiously. • Upon retum of the verdict in capital cases, judges shall give immediate instructions to the contract court reporter to begin transcription and immediately initiate an order approving the production of the transcript. • Requests for transcripts of judicial proceedings reported at public expense shall be made to the contract court reporting service. l • All materials prepared by stenographers from recorded judicial proceedings shall be properly identified and securely stored for a period of time prescribed by Florida Rule of General • If digital court reporters are unavailable for the proceeding, contract stenographic court reporters shall be used. • Digital court reporters shall operate the digital recording equipment in a manner and under conditions to capture, monitor, and annotate a reliable record. • All participants including judges, clerks, bailiffs, attomeys, and witnesses shall protect and not tamper with all electronic equipment and microphones. • Judges, General Magistrates, and Hearing Officers shall: 4 -- 4 of 7 -- a. • Attomeys shall inform their clients of the method of recording being used and take necessary precautions to protect disclosure of confidential communications during the proceeding. • Bailiffs shall ensure all participants refrain-from tampering with equipment, including the inappropriate use of microphone mute buttons or the unauthorized removal of microphones from their original location. p ’ • The Circuit’s digital recording systems shall comply with all statewide standards for digital court recording as established by the Florida Courts Technology Commission. • Request for transcripts of j udicial proceedings recorded digitally at public expense shall be made to the contract court reporting service. ' 1 • Requests for audio recordings of judicial proceedings recorded at public expense shall be made in writing per instructions found on the Fourth Judicial Circuit’s website at www.']ud4.org. • Court Reporting Services in Florida ’s Trial Courts, copies of digital recordings 5 -- 5 of 7 -- provided to attorneys of record and parties to a case shall acknowledge that confidential information may be contained on the recording and that further dissemination of confidential information is prohibited and a violation of this prohibition may subject the requester to an action for contempt of court. • Payment can be made by a cashier’s check, money order, or check made payable to the State of Florida and must be submitted with the request form. r • Back-up recordings of proceedings shall not be disclosed to persons not employed or contracted by the Court. • A Support personnel shall ensure a reliable record of court proceedings that have been recorded using digital recording equipment will be stored. • In Duval County, Court Administration shall ensure the proceeding is recorded to a primary server. . _ • In Clay County, the Clerk of Court for Clay"County shall ensure the proceeding is recorded to a hard drive and backed up on a server. • In Nassau County, the Clerk of Court for Nassau County shall ensure the proceeding is 1 recorded to a hard drive and backed up on a server.
