Verbatim from Fourth Circuit administrative order 1986-08D as published by the Duval County Clerk, harvested 2026-07-25; whitespace normalised only. • In all criminal traffic C3ses. wherein the defendant is physically arrested and booked, and where there is an accompanying civil citation. both the civil and criminal charges shall be listed on the booking repon and the citation numbers listed opposite the charge. • Said citations shall be batched and as prescribed by Section • 316.650, Florida Statutes, transmitted to the Clerk's office, and shall be numbered consecutively. • Once a defendant is arrested. and booked, all charges. both criminal and civil shall be handled by the presiding judge pursuant to Florida Rules for Traffic CourtS 6.130. • No provision oLthis order for the disposition of a civil infraction ticket shall be available to persons charged with the following offenses: ill Fleeing or altempline \0 elude a police officer, in violalion of s. 316.1935; ill Leaving Ihe scene of an accident. in violation of ss 316.027 and 316.061; ill Drivine or being in aClual phvsical control of anv vehicle while under Ihe inlluence of alcoholic beverages or anv chemical subslances controlled under Chapter 893. or driving with an unlawful blood alcohol leve!. in violation of s. 316. .193; • The Clerk shall have no authority to tJisnose of anv civil charge when accompanied bv any of the above referenced criminal offenses, • In all driving or being in actual physical control of anv vehicle while under the influence of alcoholic beverages or any chemical substances controlled under Chapter 893, or driving with an unlawful blood alcohol level, in violation of s. 316. 193 cases, where the defendant is not phvsicallv arrested and booked, and where there is an accompanving civil infraction, both the civil and criminal charges shall be batched as prescribed bv Section 316,650, Florida Statutes, transmil1ed to the Clerk's office, and shall be numbered consecutivelv. • All charges, both criminal and civil shall be handled bv the presidina jUdge pursuant to Florida Rules for Traffic Courts • The Clerk shall have nO authority to dispose of any civil charge when accompanied by the above referenced criminal offense. z;:..
