Fresno County Superior Court — Frequently Asked Questions from Law Enforcement Submitting Requests for Destruction, Disposition or Return of Seized Property

The court's answers to law enforcement agencies' frequently asked questions on requests for destruction, disposition or return of seized property: no standardized forms - each agency to draft its own documents on pleading paper; the documents captioned as to the evidence being held, not an individual, unless the application is submitted in an existing court case; an application setting out the specific statutory authority for the disposition of each item - the generic authority to hold evidence and a laundry list of statutes not sufficient; precise requests stating what property is held, how it was obtained, the proposed disposition and the authority; the Superior Court case number of an adjudicated case, so that the court can verify that the time to appeal has passed, and evidence held for over a year where no charges have been filed; the evidence list attached as an exhibit to a properly signed and sworn declaration, permanently affixed, its lines numbered and its columns fully captioned; an unsigned declaration of no evidentiary value, and declarations complying with CCP §2015.5; the warrant number in the caption and a copy of the warrant, no combining of warrants; a request in a specific Superior Court case limited to that case's evidence, except controlled substances or paraphernalia in adjudicated cases past the time for appeal; the proposed order on pleading paper, standalone, naming the current Presiding Judge and signed only by the Presiding Judge, with the evidence list attached; the person to whom property will be returned identified; and specific declarations for firearms, showing the notice procedures and statutory requirements for each firearm.
