Only sentences containing mandatory language (shall, must, may not, no later than, within N) are reproduced — the full document is in custody and is the controlling text. • One division (judge) shall be assigned all civil cases in County Court, effective January 1, 2006, until further Administrative Order. • The remaining divisions of County Court shall handle all criminal matters before the Escambia County Court. • All civil cases currently pending which have not proceeded through final hearing shall be assigned effective January 1, 2006, to the Civil Division. 2. • All criminal cases currently assigned the judge who is transferring to the Civil Division shall be divided equally by random gumball among the remaining divisions of the Escambia County Court, effective January 1, 2006. 3. • The Civil Division shall handle all civil matters, shall conduct Arraignments and First Appearances on a equal weekly rotation with the remaining divisions of the County Court, and shall accept the Century, Florida Division on a equal rotation among all judges of the County Court. • Further, the Civil Division shall take such additional caseload as directed by the Chief Judge and/or Administrative Judge of the County Court. 4. • In the event of the Civil Division Judge finding need to recuse, the cases shall be reassigned to the remaining judges of the Escambia County Court, through “gumball”. • In the event of recusal by the “Criminal” County Division, the case shall be reassigned through “gumball” among the other Criminal County Divisions. 5. • The Clerk of the Court is directed to continue the assignment of criminal cases among the remaining Criminal Divisions as is currently done with the exception that the week of Arraignments and First Appearances handled by the Civil Division judge shall be divided equally by random “gumball” among the remaining divisions of the Criminal County Court. 6. • This assignment to the Civil Division shall be for a period of two (2) years, at which time there shall be a rotation with the most senior judge having the choice of moving to Civil Division or remaining in a Criminal Division, on a descending basis thereafter (no division can repeat unless all other divisions decline the Civil Division). -- 1 of 2 -- 7. • This Civil Division shall be reviewed after six (6) months to determine if it is the appropriate way for the Escambia County Court to operate and shall be further reviewed after one (1) year to determine continuation of a Civil Division.
