Country Club Drive, Suite 217 y Port Saint Lucie, FL 34986 y (772) 807-4370 y FAX (772) 807-4377 • IN THE CIRCUITCOURTOF THE NINTEENTHJUDICIALCIRCUITIN AN FOR INDIAN RIVER, MARTIN,OKEECHOBEEANDSAINT LUCIECOUNTIES, FLORIDA ADMIN RE: Weekday, Weekend and Holiday First Appearance Hearings Schedule WHEREASFlorida Rule of Criminal Procedure 3.130 relating to First Appearances has been recently amended by the FloridaSupreme Court and is effective immediately upon release; WHEREASthe Chief Judge is now charged with the responsibility of providing and ensuring that adequate notice is given to the State Attorney and Public Defender (or their designated assistants) setting forth the times that first appearance hearings willbe held; WHEREASRule 3.130(a) is also amended to require that adequate notice be provided and that "adequate notice" may be met by the entry of a standing administrative order setting forth the times for first appearances; THEREFORE in accordance with the authority vested in the ChiefJudge pursuant to Rule 2.215, Florida Rules of Judicial Administration, it is hereby ORDERED: That each Circuit and County Judge of the 19th Judicial Circuit who is presiding over first appearance hearings on the weekdays shall notifythe State Attorney and Public Defender and/or their designated assistants as to the time that the judge handling weekday first appearances shall hold such hearings. As to weekend or holiday first appearances, effective immediately, each Circuitand County Judge of the 19th 1 • Judicial Circuitwho is presiding over first appearance hearings on weekends or holidays is to notify the State Attorney and PublicDefender and/or their designated assistants in charge in their particular county of service by no later than the Wednesday before the weekend first appearance hearings and 3 days before the holiday first appearance hearings as to when they willbe holding first appearance hearings.
