When an emergency situation or threat of an emergency arises that requires closure of the courts as determined by the Chief Judge, this Administrative Order shall be activated, and regular court operations shall cease within the affected county or counties within the Nineteenth Judicial Circuit. An emergency or threat of an emergency may arise due to a natural disaster, widespread utility failure, significant hazardous material incident, civil disturbance, or an attack or threat posed by biological, explosive, or technological weapon or any other weapon. When this Administrative Order is activated, it shall take precedence over all other administrative orders in conflict with it. • VII. NOTIFICATIONS. Upon activation of this Administrative Order, the Chief Judge will notify all judges and the Trial Court Administrator. All judges will notify their judicial assistants. The Trial Court Administrator shall, to the extent possible under emergency conditions: A. Notify all court personnel by e-mail that this Administrative Order has been activated; • B. Notify the Judicial Branch Emergency Coordinating Officer by e -mail that this Administrative Order has been activated; • C. Notify the following entities by e-mail that this Administrative Order has been activated: The Clerks of Court in the Circ uit, State Attorney, Public Defender, Sheriffs, the Department of Juvenile Justice, the Department of Children and Families, and the Emergency Management Directors for the four counties within the Nineteenth Judicial Circuit. Each entity shall provide the Trial Court Administrator with the name and e-mail address of the person to receive notification of activation of this Administrative Order; • A. Provide the Trial Court Administrator with the name and e -mail information for the person to receive notification that this Administrative Order has been activated; • B. Once this Administrative Order is activated, periodically call the Court Administration voice mail system at 772 -807-4370 to determine the status of court proceedings . In the event of the death of the Chief Judge or any other emergency that prevents the Chief Judge from carrying out his/her duties or from appointing an Acting Chief Judge, the powers and duties of the Chief Judge shall be discharged by the following Acting Chief Judge in the order of succession specified below. • XVI. RECONSTITUTION AND T ERMINATION. Once this Administrative Order is activated, regular court operations shall resume only to the degree and manner designated by the Chief Judge. HEARING TIME & ARGUMENT LIMITS • II. CESSATION OF REGULAR COURT OPERATIONS . When regular court operations cease, all court dockets, hearings, trials, and proceedings of any kind, including foreclosure sales, are cancelled except for the court’s mission essential functions identified herein. • A. First appearance hearings pursuant to Florida Rules of Criminal Procedure 3.130; • B. Detention hearings pursuant to section 985.255, Florida Statutes; • C. Shelter and dependency hearings pursuant to sections 39.402 and 39.506, Florida Statutes; • E. Ex parte hearings for temporary risk protection orders pursuant to se ction 790.401, Florida Statutes; and • IV. HEARINGS FOR MISSION ESSENTIAL FUNCTIONS. First appearances and ex parte hearings for risk protection orders may be conducted at the County Jails. Detention hearings, shelter hearings and arraignments may be conducted at the St. Lucie County Juvenile Detention Center/Juvenile Assessment Center. Hearing times and locations for mission essential functions shall be established by the Chief Judge based upon conditions at the time. • 1. The Trial Court Administrator will notify senior court staff, including the Chief Deputy Court Administr ator, PIO, CTO , Magistrates, Hearing Officers, Staff Attorneys, and Managers; • D. Designate deputy clerks necessary for Mission Essential Teams and sufficient means to manually take minutes and otherwise document court proceedings; • For proceedings cancelled during the emergency, the following procedure shall apply to rescheduling of hearings: • If the parties scheduled the hearing or the proceeding was set upon request of a party, it is the responsibility of the parties to reschedule the hearing, provided that the Court may sua sponte reschedule the matter. • In the event a catastrophic event prevents activation of this Administrative Order and communications are disrupted, the Court Emergenc y Management Teams and Mission Essential Teams will meet in the Okeechobee County Courthouse, 312 N.W. 3d Street, Okeechobee or in the St. Lucie County Courthouse Annex, 250 Country Club Drive, Port St. Lucie, at noon, 48 hours after cessation of the emergency.
