HEARING TIME & ARGUMENT LIMITS • IN THE CIRCUIT COURT OF THE NINETEENTH JUDICIAL CIRCUIT IN AND FOR INDIAN RIVER RIVER COUNTY, FLORIDA IN RE: THE GUARDIANSHIP OF CASE NO.: CIRCUIT JUDGE REBECCA WHITE Ward. _____________________________________ / ORDER FOR COMPENSATION OF EXAMINING COMMITTEE THIS MAT TER is before the Court pursuant to section 744.331(7), Florida Statutes, and the Court, having determined that the Examining Committee appointed by the Court has provided services and rendered reports as required, finds as follows: The Examining Committee is entitled to the amounts set forth below as reasonable fees for services: COMMI TTEE MEMBER PAYMENT 1. $ 2. $ 3. $ The Court fu rther finds that: ☐ The ward has been determined by the Court to be indigent, and the Examining Committee shall be paid by the State; or ☐ The ward has b een determined by the Court not to be indigent, and the Examining Committee shall be paid by the guardian from the property of the ward within days of entry of this order. Within 10 da ys of entry of this order, the guardian shall file with the Clerk of Court a notice of compliance stating that the Examining Committee has been paid in full. If the guardian fails to provide the notice of compliance within the time period specified herein, the Court, on its own initiative, shall issue an order to show cause setting a hearing at which the guardian and the guardian’s attorney shall appear and show cause why he/she should not be held in contempt of court. The guardian and the guardian’s attorney shall not be entitled to fees and costs associated with preparing for and attending the hearing. If the Examining Committee is paid in full by the guardian after issuance of the order to show cause, the guardian shall file a notice of compliance, and the hearing shall be cancelled. It is therefore ORDERED that the Examining Committee is awarded the amounts set forth above as compensation for its services, which amounts shall be paid as provided herein.
