HEARING TIME & ARGUMENT LIMITS • EXHIBIT POLICY – MAGISTRATE HILL Unless otherwise ordered, this Exhibit Policy governs all hearings and trials. 1. DEADLINES. For all hearings and trials (Zoom and in-person), the exhibits and the e-filed Exhibit List shall be provided via email to: • opposing counsel or opposing self-represented party; and • ircmagistrate@circuit19.org Unless a court order or notice of hearing establishes an earlier deadline, exhibits shall be provided as follows: Trial: No later than ten (10) days before the first day of trial. Hearings: No later than four (4) business days before the hearing. If a deadline falls on a weekend or legal holiday, the deadline is the preceding business day. 2. SUBMITTING EXHIBITS TO OPPOSING PARTY & MAGISTRATE. Do not group exhibits in a single PDF. The Magistrate Assistant will not separate them for you. Each exhibit shall be submitted as a separate exhibit/file. If you fail to follow this instruction, the Magistrate Assistant will notify you that your exhibits were not accepted and will not be considered accepted until you comply. Do not combine multiple exhibits in a single composite exhibit by subject matter or motion. Each item should be a separate exhibit /file. Failure to follow this instruction will delay a response until you comply. • 3. LABELING (MARKING) EXHIBITS. Each exhibit label shall include: • party identifier; • exhibit number; • brief description. Party identifiers: • M = Mother • F = Father • FW = Former Wife • FH = Former Husband Examples: FW-1 – FW Financial Affidavit dated 1-2-23 F-2 – XYZ Bank - monthly statements for 1/1/24 – 12/31/25 Do not mark exhibits with “P” or “Petitioner” or “R” or “Respondent.” Attorneys shall pre-mark their own exhibits using the Clerk's exhibit label format. Self-represented parties may have their exhibits pre -marked by the Clerk before the applicable deadline. (See address below.) 4. EXHIBITS FOR COURT. • In-Person Hearings and Trials: Scan and email the pre-marked exhibits to the opposing party and to the Magistrate Assistant in the same email by the deadlines in #1 above. Bring three complete sets of all pre-marked exhibits, including any electronic media for: Clerk; Witness (to use while testifying); Opposing party (unless both parties agree it is unnecessary). Do not e-file or submit exhibits to the Clerk before the hearing or trial. • Zoom Hearings and Trials: Scan and email the pre-marked exhibits to the opposing party and to the Magistrate Assistant in the same email. Audio or video recordings must be provided on a properly labeled CD. Thumb drives will not be accepted. 5. DURING THE HEARING OR TRIAL. The Magistrate will review exhibits only after they have been offered and admitted into evidence. Only admitted exhibits will be considered. Newly discovered rebuttal exhibits shall be disclosed immediately upon discovery. • Nothing in this policy alters any party's discovery obligations under the Florida Rules of Civil Procedure or the Florida Family Law Rules of Procedure. 6. AFTER THE HEARING OR TRIAL. No later than 4:30 p.m. on the next business day following the hearing or trial, the attorney who successfully admitted exhibits in evidence shall: • E-file the admitted exhibits; • E-file a List of Admitted Exhibits; and • Deliver admitted videos, etc., to the Clerk: Indian River County Clerk of Court Domestic Relations/Family Division Attn: Evidence/Exhibit Clerk 2000 16th Avenue Vero Beach, Florida 32960 Failure to do so may result in delays in the preparation/filing of the order and additional sanctions. For self-represented parties, the Clerk will scan admitted exhibits and file the List of Admitted Exhibits. 7. FAILURE TO COMPLY. Failure to comply with this Exhibit Policy or any applicable scheduling order may result in: • exclusion of exhibits; • denial of the use of exhibits at hearing or trial; • cancellation, continuance, striking of pleadings, attorney fees and costs; • other evidentiary sanctions; • any other sanction authorized by law.
