Email your pre-labeled exhibits and a copy of the e-filed exhibit list to the other party/attorney and to ircmagistrate@circuit19.org as follows (unless otherwise stated in the Order Setting Trial/Notice of Hearing): TRIAL: AT LEAST TEN (10) DAYS BEFORE THE FIRST DAY OF TRIAL. If the 10th day is on a weekend or holiday, the deadline is the first business day BEFORE the deadline. Example: If the trial is scheduled to begin on Tuesday the 17th, the deadline is Friday the 6th. HEARING: AT LEAST FIVE (5) DAYS BEFORE THE HEARING DATE. If the 5th day is on a weekend or holiday, the deadline is the first business day BEFORE the deadline. Each exhibit must be a separate document. You may send multiple emails, if necessary, due to size. Make sure your emails note “1 of 5, 2 of 5,” etc. Do not sent all the exhibits in a single PDF document. • IN-PERSON HEARINGS: In addition to emailing the pre -labeled exhibits to the Magistrate’s assistant and opposing attorney/party, you must bring at least two sets of hard copies (one for the Clerk and one for witnesses) of all labeled exhibits including electronic media to the in- person trial/hearing. The attorney who is successful in admitting exhibits into evidence at trial/hearing is responsible for e-filing the admitted exhibits AND a “List of Admitted Exhibits” with the Clerk of Court through the e-portal by 4:30 p.m. on the following business day after the trial/hearing. (The Clerk will scan admitted exhibits for pro se parties.) • ZOOM HEARINGS: You must provide via personal delivery or mail one set (hard copies) of all pre-labeled exhibits including electronic media to the Clerk of Court, Domestic Relations/Family Division at least 48 hours before the trial/hearing. Video, audio recordings, and any other electronic media must be provided to the Clerk on a CD. The CD must be labeled with the case number, case style, and evidence/exhibit number. Thumb drives will not be accepted. USBs will not be accepted. You can send multiple emails if the attachments are too big to send in one email. In the subject line of the email, state the ca se name/number, a short description of what Exhibits are attached, and how many emails you are sending with exhibits. Example: Smith v Smith 24DR277 Exhibits 1-4, Email 1 of 3. • • Adhere the labels to the front page of each E xhibit - or to a front sheet if there’s no room on the front page of the Exhibit. • • Attorneys shall pre-mark their own Exhibits using the Clerk’s format. • Failure to provide your Exhibits to the opposing party/ counsel in accordance with this Exhibit Policy will result in exclusion of the Exhibit and/or other appropriate sanctions. • This Exhibit Policy does not entitle you to respond to a discovery request with “will be provided pursuant to the court’s pre -trial order/procedures.” You must provide and update discovery in accordance with the Rules of Procedure. • Unanticipated rebuttal evidence must be submitted as soon as the party becomes aware of its existence.
