Verbatim from the order, captured live 2026-08-03 from the Duval Clerk's store; whitespace normalised only. • That monetary penalties and costs, in addition to a $5.00 surcharge, assessed upon the Q issuance of a civil citation shall be payable in a civil case pursuant to Chapter 462, Jacksonville Ordinance Code, to the Tax Collector within ten (10) days of the date on which the civil citation was issued; on the other hand, any court costs assessed in any criminal action taken as a result of issuance CT or attempted issuance of a civil citation for a violation of Chapter 462, Jacksonville Ordinance Code U, shall be imposed and made payable to the Clerk’s Oliice, Misdemeanor Department, to be deposited E into the Local Govemment Trust Fund ($50.00), the Crimes Compensation Trust Fund ($50.00), the x Additional Court Cost Clearing Trust Fund ($3.00), and into the Criminal Justice Education for Local Government ($2.00), in addition to any other court costs or fines imposed. • Such Allidavit shall indicate the citation number, shall make reference to any relevant civil action that has been filed prior to the Bling ofthe criminal action, and shall state whether there is any outstanding 2 -- 2 of 5 -- writ of attachment; f` urthermore, such Affidavit shall be filed with the State Attomey’s Office in all cases in which the Center chooses to pursue a criminal rather than a civil action. • (c) the violation of cruelty to an animal is a second or subsequent one; and (e) the violation is a third or subsequent one within a three year period), and the person cited fails to appear in court to obtain a court date or, having obtained a court date, fails to appear: l. the Court, upon the request of the Animal Care and Control Center, shall issue an order to show cause why action on the citation has not been taken; and 2. where such person fails to appear in response to the Court’s directive, the Court shall hold such person in contempt and issue a writ of attachment. • That, if through some oversight, the Animal Care and Control Center does not file a request for an Order to Show Cause in a civil case, such request shall still automatically be deemed 3 -- 3 of 5 -- to have been made by the Center (unless the Center otherwise notifies the Court in writing at the time it files its Affidavit of` Nonpayment or during a court appearance) in cases involving any of the following infractions listed, which are considered to be the more serious infractions; • That the Court, upon its discretion, may either issue a writ of attachment in the civil infraction cases or direct the Clerk ofthe Court to issue a capias in the Class D off`ense cases, and such writ or capias shall be issued in the name of the Chief Judge or of the County Court Administrative Judge, or ofthe Divisional Judge if one has been assigned, with an appropriate bond amount to assure the person’s appearance before the Court.
