In every DWI case in County Court at Law No. 2 the State must produce, on or before the 60th day after the information is filed, thirteen categories of Intoxilyzer breath-test records (instrument certificate and solution files, the Cobra Data Log and maintenance file for six months before and after the test, NIST traceability and thermometer calibration, simulator-solution procedures, software documentation and updates, operator and technical-supervisor history files and disciplinary records, unpublished operating policies, and DPS annual inspection reports a year before and after); late production is reviewed case by case for admissibility of the breath-test result, and cases already on file had a December 31, 2023 deadline.
