Remote Detention Hearing Procedures for the 33rd and 424th Judicial Districts. I. Plan Adoption: in accordance with Texas Family Code section 54.012, the 33rd and 424th District Courts in the counties of Blanco, Burnet, Llano and San Saba adopt this plan to conduct detention hearings as remote proceedings. II. Definitions: detention hearings have the meaning, scope and requirements in Family Code section 54.01; a 'remote proceeding' is one in which one or more participants (judge, party, attorney, witness, court reporter or other individual) attends remotely through technology and the internet, including teleconferencing or video conferencing. III. Procedures: (A) the court may, in its discretion, proceed with remote detention hearings under section 54.01(a), and consistent with constitutional requirements may allow or require any party, attorney, witness or court reporter to participate remotely; (B) the parties shall have the opportunity to cross-examine any witnesses; (C) the camera of any party or witness providing testimony must give an unobstructed view so the individual can be clearly seen, identified and heard, and a witness not clearly on camera will not be allowed to testify; and (D) physical evidence must be displayed so the court, attorneys, parties and witness can view it simultaneously, digital copies emailed to the district coordinators and court reporters, and physical evidence that cannot be rendered digitally tendered to the court no later than 2 days after the remote proceeding. IV. The plan was submitted to the Texas Office of Court Administration on November 14, 2023.
