In accordance with Texas Family Code section 54.012, the Comanche County Court, sitting as Juvenile Court, adopts this plan for remotely-conducted detention hearings held in Comanche County. (1) The plan applies only to juvenile detention hearings; participants in adjudication and disposition hearings must appear in person; a 'remote hearing' means a juvenile detention hearing where one or more participants appears remotely. (2) After notice to all parties and permission from the court, any participant may appear remotely, and the Court may require any or all participants to appear remotely; the Court uses Zoom, emails the hearing invitation to the attorneys (who provide it to their clients and witnesses), and is the 'host' of all remote hearings. (3) Each attorney ensures their client or witnesses have an internet-connected device with audio and video before appearing; only witnesses visible on camera may testify remotely, non-party witnesses appearing remotely should present valid identification, and witnesses not on camera will generally not be permitted to testify. (4) The court ensures each remote participant can see and hear the courtroom, and broadcasts the remote participants on a courtroom TV or monitor. (5) Attorneys email all exhibits expected to be offered to opposing counsel and the Court Coordinator no later than 24 hours before the hearing, with the full cause number and party name as the subject; the only accepted formats are PDF for documents, JPG for images, and MP4 for audio/video (no DOC formats or executables), and exhibits are saved by party designation and number (e.g., 'State's Exhibit 1'); untimely exhibits will not be considered and the court reporter will not maintain them in the record. (6) Physical evidence in remote hearings is presented per the described screen-share/print procedures depending on the location of the attorney and witness, and no physical exhibit shared via Zoom is considered before its admission into evidence.
