Standing Discovery Order in all cases filed or pending in County Court at Law Number Three: the State of Texas, by and through its District Attorney, Assistant District Attorney, or State representative, is ordered to comply with Texas Code of Criminal Procedure Article 39.14, Brady v. Maryland, 373 U.S. 83 (1963), and Kyles v. Whitley, 514 U.S. 419, 434 (1995). Within fourteen days of receiving a request under any of these authorities — which the Court finds is presumptively 'as soon as practicable' — the State is required to produce the requested information by hand delivery, mail, email, front-desk pickup, facsimile, an agreed method, or an electronic portal to which the defense has been provided access; if inspection or photographing of tangible physical evidence has been requested, the State shall set forth in writing whether it will be permitted and the method and availability. No face-to-face meeting with a State's attorney may be required as a condition of receiving requested discovery. The State shall file a motion to extend the discovery compliance date if it cannot comply within fourteen days, explaining specifically why production has not been practicable and stating the additional time needed; in no event may the State withhold available discovery because it cannot timely produce all discovery requested.
