IN RE: ALL APPLICATIONS FOR DETERMINATION OF HEIRSHIP FILED IN GREGG COUNTY, TEXAS - IN THE COUNTY COURT AT LAW NO. 1 & 2, GREGG COUNTY, TEXAS ADMINISTRATIVE ORDER AFFECTING ALL APPLICATIONS FOR DETERMINATION OF HEIRSHIP FILED IN GREGG COUNTY, TEXAS ON AND AFTER OCTOBER 1, 2024 The Courts, on their own motion, enter this Administrative Order regarding Applications for Determination of Heirship. This Administrative Order shall apply to each Application for Determination of Heirship filed in Gregg County, Texas on or after October 1, 2024. IT IS HEREBY ORDERED that for all Applications to Determine Heirship filed on or after October 1, 2024, the Clerk of the Court shall collect a deposit in the amount of $400.00 in every cause in addition to the filing fee for an Application for Determination of Heirship filed pursuant to Chapter III of the Texas Probate Code or an Application for a Declaratory Judgment Determining Heirship filed pursuant to Chapter 37 of the Texas Civil Practice and Remedies Code. This deposit shall be held by the Clerk of the Court for the payment of the fees of the Attorney Ad Litem upon a proper Order directing the taxing of the same as costs in the proceeding. IT IS FURTHER ORDERED that all Attorneys Ad Litem appointed pursuant hereto shall be required to follow the Due Diligence Checklist and other materials provided by the Court. IT IS FURTHER ORDERED that all Attorneys Ad Litem appointed pursuant hereto shall receive a fee of $400.00 for services as an Attorney Ad Litem, and shall notify the Court and receive prior approval for any fees and expenses to be incurred in excess of the fee herein set, and shall file a Sworn Statement of Services and Expenses upon completion of the Case. IT IS FURTHER ORDERED that all Attorneys Ad Litem appointed pursuant hereto shall be awarded a fee and shall be discharged under an Order separate from the Order Declaring Heirship.
