In the County Court of Guadalupe County, Texas — Blanket Order Authorizing Release of Mental Health Court Records Pursuant to Section 571.015 of the Texas Health and Safety Code. House Bill 3352 (codified at Texas Government Code sections 411.052 and 411.0521 and Health and Safety Code section 574.088) was passed by the 81st Texas Legislature in 2009 to implement the federal NICS Improvement Amendments Act of 2007 (NIAA), which amended the Brady Handgun Violence Prevention Act under which the National Instant Criminal Background Check System (NICS) was established; because many prohibited persons are not prevented from purchasing firearms when their records are not in NICS, the order authorizes the release of the relevant mental-health court records so that qualifying adjudications and commitments are reported to NICS as required by state and federal law.
