Standing Order Regarding Public Access to DFPS Court Records for Bosque, Comanche, and Hamilton Counties, issued by the 220th Judicial District Court (Administrative Judge Shaun Carpenter). On May 30, 2024, the Court considered pleadings, orders and documents filed in suits brought by the Department of Family and Protective Services (DFPS) under Chapters 261, 262, and 264 of the Texas Family Code, and found that the Child Abuse Prevention and Treatment Act (CAPTA, 42 U.S.C. 5106a) generally requires states to preserve the confidentiality of child abuse and neglect reports and records, that Texas Family Code section 261.201 deems DFPS records of alleged abuse or neglect confidential and not subject to public release absent a court order following an in-camera inspection and a finding of necessity, and that these documents contain sensitive information about children who have been or may have been abused or neglected and about family members including alleged perpetrators. IT IS THEREFORE ORDERED that public access to pleadings, orders and documents filed in a DFPS suit under Chapters 261, 262 and 264 of the Texas Family Code is restricted and maintained by the District Clerk as such; the Clerk shall not allow public access other than to DFPS, the parties, their attorneys, the attorney ad litem and the guardian ad litem unless specifically permitted and ordered by the Court, and the Clerk is directed to submit a copy of the order with the Office of Court Administration's Local Rules, Forms and Standing Orders website.
