ALL CASES SET IN THE 334TH IN THE DISTRICT COURT OF HARRIS COUNTY T E XAS 334TH JUDICIAL DISTRICT PRETRIAL ORDER ALL ITEMS ARE DUE AT PRE-TRIAL CONFERENCE OR AT TIME OF TRIAL STATEMENT OF THE CASE Give a brief statement of the case, estimated trial length and any potential attorney or witness conflicts or travel difficulties for the information of the Court. DEPOSITION EXCERPTS OR EDITED VIDEOTAPES Designate page and line in sequence to be used at trial and provide a copy of each deposition offered to the court reporter, along with deposition designations on a USB flash drive. These items are due at the pre-trial conference or at the commencement of trial. ADMISSIONS OF FACT List all facts which have been stipulated and admitted. CONTESTED ISSUES OF FACT List all factual issues in controversy necessary to the final disposition of this case. EXHIBITS Each counsel will attach to the Joint Pretrial Order a copy of the list of all exhibits to be offered and will make all such exhibits available for examination by opposing counsel. This rule does not apply to rebuttal exhibits which cannot be anticipated. Any counsel requiring authentication of an exhibit must so notify in writing the offering counsel within five days after the exhibit is made available to opposing counsel for examination. FAILURE TO DO SO is an ADMISSION of authenticity. The offering party will MARK THEIR OWN EXHIBITS AND PROVIDE A SET OF EXHIBITS AND AN EXHIBIT LIST TO THE COURT REPORTER ON A USB FLASH DRIVE. MOTIONS IN LIMINE Attach Motions in Limine and confer in advance to determine whether any motions are agreed. Parties should not include anything contained or covered by the Court's Standing Order in Limine. See Court's webpage at justex.net WITNESSES List the names and addresses of witnesses, including parties, who will or may be called to testify, with a brief statement of the subject matter and substance of their testimony. Include in this section whether they are fact or expert witnesses. ATTACHMENTS Include the following REQUIRED attachments: For a jury trial: Proposed Jury Charge should be filed with the Clerk and be submitted to the court in an editable format on an USB FLASH DRIVE. Word Perfect is not compatible with the Court's computer. Modifications may be made as trial progresses. For a non-jury trial: Proposed Findings of Fact and Conclusions of Law must be sent to the Court by the same method as above, with supporting authorities in a memorandum of law. FAILURE TO COMPLY WITH THE FOREGOING MAY RESULT IN EXCLUSION OF EXHIBITS, WITNESSES, OR MOTIONS. FAILURE TO REVIEW ITEMS TENDERED BY OPPOSING COUNSEL MAY RESULT IN WAIVER OF OBJECTION THERETO.
