LITTLEFILED, COUNTY COURT AT LAW NO. 2 ADMINISTRATIVE ORDER REGARDING ESTATES CODE §1101.003 AFFIDAVIT CONTAINING CONTACT INFORMATION OF CERTAIN PERSONS The Hunt County Courts at Law find that there is a need for an administrative order regarding Texas Estates Code §1101.003. The Court finds as follows: 1. §1101.003(a) of the Texas Estates Code of requires that: Within the time prescribed by the court, a person who files an application under Section 1101.001 shall file an affidavit with the court that states the name, address, telephone number, e-mail address, and other contact information if known by the applicant for each person entitled to notice under Section 1051.104(a). (Emphasis added) 2. §1101.003(b) of the Texas Estates Code provides that: An affidavit filed under this section is privileged and confidential. The affidavit may not be released or otherwise disclosed to the public. (Emphasis added) It is therefore ORDERED that, effective immediately, when a person files an application for the appointment of a guardian pursuant to §1101.001: 1. The applicant shall file with the court the affidavit containing contact information of certain persons pursuant to §1101.003 at east 10 days prior to prove-up, trial or other final disposition. The affidavit shall be captioned "§1101.003 Affidavit Containing Contact Information of Certain Persons." 2.
