Submitting Paperwork for Probate Hearings (Lampasas County Court). It is the Court’s policy to review necessary documents for all probate prove-up hearings before the hearing. Steps: (1) e-file the application; (2) if the death occurred outside Lampasas County, email the decedent’s death certificate (Social Security Number redacted) to the Court; and (3) per Texas Rule of Civil Procedure 21(f)(12), any original will must be physically filed in the Clerk’s office within three business days of electronically filing the application (a copy being probated must likewise be physically filed) — do not e-file the will with the application. Before requesting a hearing date the following must be completed and e-filed when applicable: service of citation on, or a waiver form from, all non-applicant heirs and other persons requiring notice under Texas Estates Code section 202.008; consents from all heirs if seeking independent administration; an affidavit of citation by publication for heirship determination (the Clerk prepares the citation, which is published, then the affidavit is filed — the Clerk handles citation by publication on the OCA website); and a section 202.057 affidavit or certificate. Once the hearing is set: email the proposed Proof of Death, Order Admitting Will to Probate, Oath and any other hearing documents to the Court at least three days before the hearing; do not e-file documents that should be signed at or after the hearing (testimony, oaths, Proof of Death and Other Facts — signed documents may be e-filed after a remote hearing); and e-file the Order so the Judge can sign it electronically and the parties receive signed copies.

Judge Wolfe enforces AO S-2024-062(28)(A) with teeth: every pretrial motion in a case transferred to TD-3 must be scheduled and heard by the original transferring judge — failure to do so timely is deemed a waiver.
Judge Rice mirrors the F-division waiver with an exception: all motions other than motions in limine must be filed AND heard before the Pretrial Conference or they are waived; limine motions must at least be filed by then.
