The county-wide master administration rules of the Board of Judges (all district judges + all CCL judges), made under Gov't Code § 74.093 in compliance with the Second Administrative Judicial Region's Regional Rules of Administration, applying to all cases within district-court and CCL jurisdiction: Rule 1 designates six court divisions (Civil, Probate, Family law, Juvenile, Felony, Misdemeanor), designates each district court and CCL as a specialized court within one or more divisions, and DELEGATES § 74.093 rule-making to each division's judges (acknowledging the division rule-sets: civil, probate, family practice + administration, juvenile, felony, misdemeanor); Rule 2 adopts the Commissioners-Court-approved Jury Plan filed with the District Clerk; Rule 3 lets judges request assigned-judge coverage for vacation, illness, conferences, dual dockets, and similar needs; Rule 4 governs local administration — concurrent-jurisdiction cases file with the District Clerk and are assigned between the district courts and CCLs by a written assignment order signed by BOTH the Local Administrative District Judge and the Local Administrative Statutory County Court Judge (exclusive-jurisdiction classes by the respective LAJ's order with the respective clerk; alterations need every affected judge's signature and terminate per their terms, on a signer's termination order, or when a new judge takes a signing bench without ratifying), cases stay on the assigned docket unless transferred, misfiled cases auto-transfer before citation issues; LAJ elections (district: two-year terms elected by December under § 74.091; statutory county: one-year terms under § 74.0911) with meeting/quorum mechanics, inequitable-burden transfers within each tier, JOINT district-CCL transfers on both LAJs' signed order, § 74.092 duties, and Board-of-Judges meetings run by the LADJ in even years and the LASCCJ in odd years; every court appoints a court administrator/coordinator with enumerated duties (settings, notices, scheduling orders, setting coordination, juror coordination); VOLUNTARY RECUSAL without motion routes the case to the Second Administrative Judicial Region's judge for assignment (or transfer to the next rotation court); Rule 18a and the REGIONAL Rules of Administration govern recusal/disqualification motions, with referral forms available from the region's administrative office; each court may promulgate recording/broadcast rules; conflicting-engagement priorities (criminal, statutory preference, preferential settings, earliest set, earliest filed; metro yields to rural; unresolved conflicts to the LAJ or Regional Presiding Judge); weekly-minimum dockets per Supreme Court time guidelines; and adoption/amendment mechanics (effective Jan. 1, 2023; per-tier opt-out under TRCP 3a via Rule 5.5, which itself cannot be amended; recorded in the minutes of the 9th, 221st, 284th, 359th, 410th, 418th, 435th, and 457th District Courts and CCLs 1–6). Application: "These rules apply to all cases over which the District Courts and County Courts at Law of Montgomery County, Texas have jurisdiction." Rule 1.1: the Board of Judges "designates the following court divisions...: Civil; Probate; Family law; Juvenile; Felony; and Misdemeanor," designates each district court and CCL "as a specialized court within one or more of the above divisions," and "delegates and assigns its rule making authority under Texas Government Code §74.093 to the judges of each court division." Rule 2.1: "the Board of Judges has adopted the Jury Plan which has been approved by the Commissioner's Court... and has been filed with the District Clerk." Rule 4.1(a): "All cases within the concurrent jurisdiction of the District Courts and the County Courts at Law shall be filed with the District Clerk and assigned... according to a written order of assignment signed by both the Local Administrative District Judge and the Local Administrative Statutory County Court Judge." 4.1(b)-(c): exclusive-jurisdiction classes are assigned by the respective LAJ's written order filed with the respective clerk. 4.1(d): alternative assignment orders need the signature of "the judges of all courts affected" and "terminate upon the language in the assignment order, upon an order terminating... signed by any judge who originally signed..., or upon a new judge assuming the bench of a signing judge unless the assignment order is ratified by that judge." 4.1(f): "If citation in the misfiled case has not issued, the District Clerk or County Clerk shall automatically transfer any such misfiled case to the proper court." Rule 4.2(a): a majority of district judges elect the LADJ for two-year terms (Gov't Code § 74.091); the LADJ "may transfer cases between District Courts if he/she finds that a court has an inequitable burden." 4.2(b): the CCL judges elect the Local Administrative Statutory County Court Judge for one-year terms (§ 74.0911) with the same transfer power between CCLs. 4.2(c): joint findings allow transfers "between District Courts and County Courts at Law" on both LAJs' signed order. 4.2(e): Board meetings are called and run by the LADJ in even-numbered years and the LASCCJ in odd-numbered years, with quorum and majority-action requirements. Rule 4.3: "Each court shall appoint a court administrator and/or coordinator" with duties covering trial/hearing setting procedures, notices, scheduling-order preparation, setting coordination, and juror coordination with the District Clerk's office. Rule 4.4: "At any time prior to a motion to recuse being filed, a judge may voluntarily recuse himself/herself, and in such circumstance must refer the case to the Judge of the Second Administrative Judicial Region for assignment of another judge," or request transfer "to the next court in rotation that hears the same type of cases." Rule 4.5: "Rule 18a of the Texas Rules of Civil Procedure and the Regional Rules of Administration for the Second Administrative Judicial Region of Texas shall govern procedures upon the filing of a motion for recusal or disqualification," with referral forms "available through the Administrative Office for the Second Administrative Judicial Region." Rule 4.7(b): dual-setting priorities — "Criminal Cases; Cases given preference of statute; Preferentially set cases; Case set at earliest date; Case with earliest filing date; Courts in metropolitan County areas should yield to Courts in rural County areas...; In event of unresolved conflict between two judges, the issue will be decided by the Local Administrative Judge or the Regional Presiding Judge." Rule 4.8: "Court shall be held at least once a week" unless other intervals are more efficient. Rule 5.2: "These rules shall become effective on January 1, 2023."
