The 258th Judicial District’s standing criminal discovery order (Judge Kitchens, eff. Jan. 1, 2023), applying in all criminal cases until ordered otherwise: the State must furnish all Michael Morton Act (CCP art. 39.14) discovery plus a written trial-witness list (including experts) with addresses, supplemented within 30 days of arraignment; all written/recorded defendant statements and confessions (CCP art. 38.22), any jail conversations it intends to use and any known Brady evidence (with the defense entitled to listen to the defendant’s jail calls in the State’s possession on request); written notice of intent to use extraneous-offense evidence (TRE 404(b)); and inspection of items seized from the defendant and any co-defendant/accomplice.

The State shall provide any jail conversations it intends to use at trial or any Brady evidence the State has actual knowledge of. The Defense shall have the right to listen to all jail conversations of the Defendant in the possession of the State upon request... 3.
