A Robertson County addendum to the 82nd Judicial District local rules establishing criminal case-management procedures to meet the Legislature’s 90% disposition mandate, governing trial order, mandatory pretrial conferences, continuances, and discovery.

Addendum to the Local Rule for the 82nd Judicial District — Robertson County (entered May 19, 2025; effective June 1, 2025). Whereas the District Court has been mandated by the Texas Legislature to maintain a 90% disposition rate of all pending criminal cases, and failure may result in judicial sanction by the Texas Supreme Court or the Office of Court Administration, the following rules apply in all criminal cases in Robertson County: (1) the Court shall determine the order in which cases are presented for jury trial; (2) if a defendant has more than one pending case the Court will order which case proceeds to trial; (3) a pretrial conference will be held no less than 60 days before trial — the pretrial conference is mandatory and held on the record, at which the Court takes up any pretrial matters except Motions in Limine, all modifications to indictments are done before the pretrial conference, and any notices of enhancement are done at or before the pretrial; (4) all requests for continuances must be filed no later than 30 days before trial, and a motion for continuance filed within 30 days of trial will not be considered unless there is an emergency (the unavailability of an expert or fact witness is not an emergency); and (5) all discovery must be delivered or made available to the attorney for the defendant prior to the pretrial.

Judge Wolfe enforces AO S-2024-062(28)(A) with teeth: every pretrial motion in a case transferred to TD-3 must be scheduled and heard by the original transferring judge — failure to do so timely is deemed a waiver.
Judge Rice mirrors the F-division waiver with an exception: all motions other than motions in limine must be filed AND heard before the Pretrial Conference or they are waived; limine motions must at least be filed by then.
