This General Order applies to all parties when seeking to introduce an audio, video, CD, DVD or other electronic media storage device. The sponsoring party must ensure the exhibit is in a format that may be uploaded and accepted by the appropriate Court of Appeals; electronic evidence must be submitted in one of the following formats: .avi, .wmv, .wav, .mpg, .mid, .asf, .mpeg, .mp1, .mp2, .mp3, .mp4, .m4v, .ogg, .oga, .ogv, .webm, and otherwise be converted to an acceptable format. Audio exhibits may not exceed 100 MB and video files may not exceed 5 GB per file; larger files are divided and labeled. Only the segments offered as an exhibit may be on the medium. Oversized or enlarged exhibits must be accompanied by 8-1/2-by-11-inch copies with a marked exhibit sticker, which the court reporter retains for the record on appeal, and the 8-1/2-by-11-inch copy becomes the official exhibit. Each computer file of a text document must be submitted in text-searchable PDF compatible with the latest Adobe Reader, not password-protected or encrypted, and all scanned exhibits made searchable using optical-character-recognition software. Judge Miller: exhibits for remote hearings must be premarked and physically delivered (U.S. mail or courthouse drop box) at least three business days out or they are not considered — e-mailed exhibits are refused, and evidentiary hearings are never remote.
