Tex. Health & Safety Code § 85.260 · Subchapter J. HOME COLLECTION KITS FOR HIV INFECTION TESTING
CONFIDENTIALITY.
Text — Current through the 89th 2nd Called Legislative Session, 2025
(a) Any statement that an identifiable individual has or has not been tested with a home collection kit for HIV infection testing, including a statement or assertion that the individual is positive, is negative, is at risk, or has or does not have a certain level of antigen or antibody, is confidential as provided by Section 81.103.
(b) A person commits an offense if the person violates this section. The punishment for an offense under this section is the same as the punishment for an offense under Section 81.103.
