MASUNAGA SUBJECT: STANDING ORDER RE: 14601.1(a) VC AND REDUCTION TO AN INFRACTION PER OFFER OF THE DISTRICT ATTORNEY’S OFFICE Pursuant to open offer of the District Attorney’s Office, see attached letter dated June 4, 2007, if the defendant charged with a VC §14601.1(a) only, shows proof of a valid license from the Department of Motor Vehicles at time of initial arraignment or first pretrial, the Court will order the offense reduced to an infraction pursuant to PC §19.8, impose a fine and the court security fee. COUNTY OF SISKIYOU OFFICE OF THE DISTRICT ATTORNEY J. KIRK ANDRUS, DISTRICT ATTORNEY June 4, 2007 The Honorable Laura Masunaga Siskiyou County Superior Court 311 Fourth St., Room Yreka, CA 96097 Re: Defendants w/ Pending Charges of Vehicle Code Section 14601.1(a). Dear Judge Masunaga: As you are aware charges of violation of Vehicle Code Section 14601.1(a) may be reduced to infractions pursuant to Penal Code Section 19.8. This is to inform the court of an open offer from our office to all defendants charged with this violation at the misdemeanor level. If they produce proof from DMV that they have cleared their license of all suspensions at arraignment or no later than the first pre-trial conference, then our office will motion to reduce the charge to an infraction. If a representative of our office is not present, then we request that the court reduce the charge under these circumstances. This open offer does not apply to defendants who are charged with any priors, or violations of VC 14601(a), 14601.2 (a) or (b), and 14601.5(a). We hope that this will encourage people to pay fines due and otherwise perfect their license status with DMV. Request that the court inform defendants of this opportunity at the arraignments or at other times as appropriate. Respectfully, Martha Aker Deputy District Attorney Acting Misdemeanor Supervisor P.O. BOX 986 YREKA, CALIFORNIA 96097-0986 (530) 842-8125 FAX (530) 842-8137

Not part of the text: the rubber stamp “ORIGINAL”, the letterheads' drawing and the District Attorney's seal, the handwritten initials beside the memorandum's FROM line, the handwritten distribution list and the word-processing file path printed below it, the court's RECEIVED stamp on the letter and the letter's signature; the memorandum and the letter it attaches are set one after the other as the file carries them. The transcription's closing note, which describes the pages, is not published. Review note: The memorandum rests on the District Attorney’s open offer of June 4, 2007, its attached letter; the court’s Order re Standing Orders of June 24, 2025 keeps the standing order in effect, but neither says whether the District Attorney’s open offer still stands (a review task).
