Only sentences containing mandatory language (shall, must, may not, no later than, within N) are reproduced — the full document is in custody and is the controlling text. • PROCEDURES FOR RECUSALS AND DISQUALIFICATIONS WHER-EAS, pursuant to Administrative Order 2012-58, Judicial Assignments - Judicial Absence/ Disqualificatiott/Recusal, the ChiefJudge delegated responsibility to the Clerks ofCourt to reassign cases tojudges upon disqualifications/recusals within a county when alljudges in a county disquali[,/recuse, and, WHEREAS, due to size in Santa Rosa County, some divisions are designated to a single judge; thus, in the best interest ofjudicial efficiency and utilization of circuit and county judges, a procedure was developed regarding the reassignment ofcases tojudges within Santa Rosa County, as to disqualifications and recusals, and WHER"EAS, SRCAD 2020-03, Santa Rosa Circuit Division Assignments Effective January 1, 2021, realigned court division assignments, necessitating a modification to the current procedure for reassigning cases resulting from recusals or disqualifications within Santa Rosa County, it is therefore, ORDERED, that, effective immediately, the Clerk of Court shall utilize the following procedures when reassigning cases, due to a recusal or disqualification, within Santa Rosa County: • Division A (Circuit Criminal and Civil) - Any cases wherein the Division A judge disqualifies/recuses, the case shall be reassigned to Division B. • Should the Division Bjudge disquali!/recuse, the case shall be randomly reassigned between Division C and Division D. • If all circuitjudges disqualifu/recuse, the case shall be randomly reassigned among the county judges. • Division B (Circuit Criminal and Civil) - Any case wherein the Division B judge disqualifies/recuses, the case shall be reassigned to Division A. • Should thejudge in Division A disqualifu/recuse, the case shall be randomly reassigned between Division C and Division D. lfall circuitjudges disqualifo/recuse, the case shall be randomly reassigned among the county judges. • Division C (Family Law) -Any case wherein the Division C judge disqualifies/recuses, the case shall be randomly reassigned among the circuitjudges. • Ifall circuitjudges disqualifo/recuse, the case shall be randomly reassigned among the countyjudges. • Division D (Dependency/Delinqrrencrl?rqb4lte//Gu4rdianrhip) - Any case wherein the Division D judge disqualifies/recuses, the case shall be randomly reassigned among the circuitjudges. • Ifall circuitjudges SRCAD 202 l-01, Procedures for Recusols and Disqualifications -- 1 of 3 -- disqualify/recuse, the case shall be randomly reassigned among the countyjudges Domestic Violence Iniunctions - Any case wherein a circuitjudge disqualifies/recuses, the case shall be randomly reassigned among all other circuitjudges. • Ifall circuitjudges disqualiflrecuse, the case shall be randomly reassigned among the county judges. • Countv Court Divisions - Any case wherein a countyjudge disqualifies/recuses, the case shall be reassigned to the other countyjudge. lfboth countyjudges disquali!/recuse, the case shall be randomly reassigned among the circuit judges. • Masistrate Division E (Familv Law) - Any case wherein the Division E Magistrate disqualifies/recuses, thecase shall be reassigned to Division C. • Ifthe Division C judge disqualifies/recuses, the case shall be randomly reassigned among the circuitjudges. lf all circuitjudges disqualil!/recuse, the case shall be randomly reassigned among the county judges. • Maqistrate Division E (Countv Civil) - Any case wherein the Division E Magistrate disqualifies/recuses, the case shall be randomly reassigned among the countyjudges. • Ifboth county courtjudges disqualifo/recuse, the case shall be randomly reassigned among the circuitjudges. • This administrative directive shall supersede all previous direction regarding procedures for disqualificationVrecusals within Santa Rosa County, to include the most recent memorandum dated April 8,2019, to the Clerk of Court. • Upon disqualification/recusal ofalljudges in Santa Rosa County, and, when randomly reassigning cases received from another county, the Clerk ofCou( shall follow the procedures as outlined in Administrative Order 2012-58. • SRCAD 2021-01, Procedures for Recusals and DisqualiJications Masistrate Division E (Baker Act/Marchman Act) - Any case wherein the Division E Magistrate disqualifies/recuses, the case shall be randomly reassigned among the circuitjudges. • Ifall circuitjudges disqualifu/recuse, the case shall be randomly reassigned among the countyjudges.
