Only sentences containing mandatory language (shall, must, may not, no later than, within N) are reproduced — the full document is in custody and is the controlling text. • PROCEDURES FOR RECUSALS AND DISQUALIFICATIONS Vacates SRCAD 2021-01 WHEREAS, pursuant to Administrative Order 2012-58, Judicial Assignments – Judicial Absence/ Disqualification/Recusal, the Chief Judge delegated responsibility to the Clerks of Court to reassign cases to judges upon disqualifications/recusals within a county when all judges in a county disqualify/recuse, and, WHEREAS, due to size in Santa Rosa County, some divisions are designated to a single judge; thus, in the best interest of judicial efficiency and utilization of circuit and county judges, a procedure was developed regarding the reassignment of cases to judges within Santa Rosa County, as to disqualifications and recusals, and WHEREAS, SRCAD 2024-02, Santa Rosa Circuit Division Assignments, realigned court division assignments, necessitating a modification to the current procedure for reassigning cases resulting from recusals or disqualifications within Santa Rosa County, it is therefore, ORDERED, that, effective immediately, the Clerk of Court shall utilize the following procedures when reassigning cases, due to a recusal or disqualification, within Santa Rosa County: • Division A (Circuit Civil) – Any cases wherein the Division A judge disqualifies/recuses, the case shall be reassigned to Division B. • Should the Division B judge disqualify/recuse, the case shall be randomly reassigned between Divisions C, D and E. • If all circuit judges disqualify/recuse, the case shall be randomly reassigned among the county judges. • Division B (Circuit Criminal) – Any case wherein the Division B judge disqualifies/recuses, the case shall be reassigned to Division A. • Should the judge in Division A disqualify/recuse, the case shall be randomly reassigned between Divisions C, D and E. • Division C (Family Law) –Any case wherein the Division C judge disqualifies/recuses, the case shall be reassigned to Division E. • Should the Division E judge disqualify/recuse, the case shall be randomly reassigned between Divisions A, B and D. • If all circuit judges disqualify/recuse, the case shall be randomly reassigned among the county judges. -- 1 of 3 -- SRCAD 2025-02, Procedures for Recusals and Disqualifications Division D (Dependency/Delinquency/Probate/Guardianship) – Any Dependency case wherein the Division D judge disqualifies/recuses, the case shall be reassigned to the Division A judge. • Any Delinquency case wherein the Division D judge disqualifies/recuses, the case shall be reassigned to the Division B judge. • Any Probate case wherein the Division D judge disqualifies/recuses, the case shall be reassigned to the Division C judge. • Any Guardianship case wherein the Division D judge disqualifies/recuses, the case shall be reassigned to the Division E judge. • If any of the initial reassigned judges recuse, the case shall be randomly reassigned among the circuit judges. • Division E (Family Law) –Any case wherein the Division E judge disqualifies/recuses, the case shall be reassigned to the Division C judge. • Should the Division C judge disqualify/recuse, the case shall be randomly reassigned between Divisions A, B and D. • Domestic Violence Injunctions - Any case wherein a circuit judge disqualifies/recuses, the case shall be randomly reassigned among all other circuit judges. • Division 1 County Criminal – Any case wherein the Division 1 judge disqualifies/recuses, the case shall be reassigned to the Division 2 judge. • If the Division 2 judge disqualifies/recuses, the case shall be reassigned to the Division 3 judge. • If all county judges disqualify/recuse, the case shall be randomly reassigned among the circuit judges. • Division 2 County Criminal – Any case wherein the Division 2 judge disqualifies/recuses, the case shall be reassigned to the Division 1 judge. • If the Division 1 judge disqualifies/recuses, the case shall be reassigned to the Division 3 judge. • Division 3 County Civil – Any case wherein the Division 3 judge disqualifies/recuses, the case shall be randomly reassigned between the Division 1 and 2 judges. • If the reassigned county judge recuses, the case shall be reassigned to the remaining county judge. • If all county judges recuse, the case shall be randomly reassigned among the circuit judges. • Division 3 Baker Act/Marchman Act - Any case wherein the Division 3 judge disqualifies/recuses, the case shall be randomly reassigned among the circuit judges. • If all circuit judges disqualify/recuse, the case shall be randomly reassigned among the county judges. -- 2 of 3 -- SRCAD 2025-02, Procedures for Recusals and Disqualifications This administrative directive shall vacate SRCAD 2021-01 and supersede all previous direction regarding procedures for disqualifications/recusals within Santa Rosa County. • Upon disqualification/recusal of all judges in Santa Rosa County, and, when randomly reassigning cases received from another county, the Clerk of Court shall follow the procedures as outlined in Administrative Order 2012-58.
