Verbatim from the operative section of https://www.jud12.flcourts.org/Portals/0/AdminOrders/Section03/10-14.3.pdf, harvested 2026-08-02; whitespace normalised only. • The Custodial County shall not release the inmate if the inmate is scheduled to appear in criminal court in the Custodial County within five (5) business days of receipt of the request to transfer custody, unless the Charging County produces written notice from its State Attorney's Office stating: (a) That a speedy trial calendar call has been held pursuant to Rule 3.191, Florida Rules of Criminal Procedure, and that a trial date has been set within the referenced five (5) business day period; or (b) That there are extenuating circumstances warranting the immediate transfer of the inmate to the Charging County. The burden to determine whether an inmate is scheduled to appear in criminal court in the Custodial County within five (5) business days of receipt of the request to transfer custody shall lie with the Custodial County. The burden to produce written notice from the State Attorney's Office regarding (2a) and (2b) above for the Custodial County shall lie with the Charging County.
