Failure of the person to file the financial affidavit shall subject the suit to dismissal. • If the judge decides to set the indigency matter for hearing, the judge's judicial assistant shall contact the person seeking indigent status and shall schedule a hearing as soon as practical. • Upon the applicant's failure to timely return the affidavit or if the judge daterminas that the person is not indigent from the information provtded in the financial affidavit and a hearing on the issue is not necessary, the judge shall issue an order declaring the person solvent and revoking the initial certification of insolvency. lf payment of the appropriate fees are not made to the Clerk within 10 days after the filing of the revocation order, the case shall automatically be dismissed without prejudice. The '-·• Clerk shall forward to the judge a proposed dismissal order essentially in the form of Attachment B. • In all cases where a litigant is indigent, the Clerk shall only issue one copy cf the indigent's p!eadings to the named party or parties to the lav,suit. • In the event that muitiple parties to a case seek indigent status, each party must complete an affidavit of insolvency and each party must complete the financial affidavit described and incorporated in this Administrative Order before the Clerk will accept for filing under §57.081, Florida Statutes. Notes interpreting that ruie, the Cierk shaii not serve copies for iitigious persons appearing in proper person who are familiar with the requirements of the rules of court.
