New Rules eliminate the “at issue” requirement and instead provide that “the failure of the pleadings to be closed will not preclude the court from setting a case for trial.” If your case does not yet have a firm trial period, the Plaintiff is required to immediately notify the Court as soon as the pleadings are closed and the case is at issue to request one.
