Verbatim from the order, captured live 2026-08-03 from the Duval Clerk's store; whitespace normalised only. • That the Fourth Judicial Circuit shall adopt the following policy to protect the rights of potential deaf jurors to serve on a jury pursuant to the ADA: l . • The Fourth Judicial Circuit shall give primary consideration to the accommodation requested by a deaf or hard of hearing juror; • A deaf or hard of hearing juror shall not be removed prior to voir dire solely due to deafness (unless removal is sought by the juror, or removal is not based on Florida Statute § 40.013 (5), but may be removed if another statutory requirement prohibits his or her service), regardless if the recommendation for removal is made by a Bailiff, lawyer or Judge; -- 1 of 3 -- OR BK 16219 PAGE 830 4. • To ensure compliance with § 40.013 (5), Florida Statutes, and to prevent unauthorized dismissal or excuse, all questioning as to a deaf juror’s disability, needed accommodations, and all other inquiries as to qualification must be done on the record in consult with the deaf juror; • Both the evaluation of the juror under these circumstances and the J udge’s findings must be put on the record and performed in consult with such juror; • When a deaf juror is unable to articulate to the Court which accommodation or auxiliary aid is needed to provide effective communication due to unfamiliarity with either technology or the support services available, the Court shall contact the Circuit Court’s ADA Coordinator or the Statewide Court ADA Coordinator for auxiliary aid assistance;
