Verbatim from Fourth Circuit administrative order 2001-07 as published by the Duval County Clerk, harvested 2026-07-26; whitespace normalised only. • E WHEREAS, the case load in the Duval County 'Traffic Court is ever-increasing, and exists as :5 a constant demand on the Court’s time and resources; g WHEREAS, it appears in the best interest of the people of Duval County to insure that the { Court disposes of matters before it in the most efficient and expedient way possible; £ WHEREAS, Rule 6.360 of the Florida Traffic Court Rules provides a mechanism for enlargement of the time in which a defendant must appear in traffic court; • WHEREAS, Rule 6.480 of the Florida Traffic Court Rules provides a mechanism for enlargement of the time in which a defendant must render payment for any penalty imposed pursuant to a traffic citation; • (A) The Clerk of Court shall have the authority to issue continuances in traffic court cases, at the request of the defendant, pursuant to the following requirements: • (l) The Clerk of Court shall advise a defendant requesting a continuance that any defendant who requests and is granted a continuance pursuant to the provisions of this Order shall be considered to have waived any rights to a speedy trial pursuant to Rule 6.325 of the Florida Traffic • (2) The Clerk of Court shall issue only one (l) continuance per defendant. • There shall be a notation made of each continuance issued to ensure compliance with this requirement. • (4) For requests for continuance made before the scheduled court date, the date to which the appearance is continued shall be within thirty days ofthe originally scheduled appearance -- 1 of 2 -- date; • O (5) For requests for continuance made after the originally scheduled court date, if such g request is made within ten (10) calendar days of the original court date, the Clerk of Court shall recall • U) .2 (6) These provisions for continuance shall not apply to motions for rehearing, or to the • (B) All defendants shall have ninety (90) calendar days from the date of receipt of the citation in which to render payment for any penalty imposed. lf a defendant has not rendered payment in full by the end of such time, the Clerk of Court shall commence administrative action for suspension of the defendant`s driving license. • The above ninety days shall be considered sufficient time in which to pay the required penalty, and no continuances for payment shall be permitted. • (C) Any defendant who fails to schedule a court date within thirty (30) days of receipt of the citation, as provided on the face of the citation, shall be considered to have waived any rights to a speedy trial pursuant to Rule 6.325 of the Florida Traffic Court Rules. • (D) That this Order shall take effect immediately and remain in effect until further Order of the • Court, and all terms and conditions set forth in this Administrative Order shall apply unless otherwise ordered by the Court. • (E) That this Order shall be recorded in the Official Records of Duval County in the State of
