Verbatim from Fourth Circuit administrative order 2002-02 as published by the Duval County Clerk, harvested 2026-07-26; whitespace normalised only. • Effective January l, 2002 , any person (juvenile or adult) who is convicted, regardless of adjudication, for any offense or attempted offense defined in Florida Statutes chapter 794 sexual battery; chapter 800 lewdness; section 782,04 murder; section 784.045 aggravated battery; section 810.02 burglary; section 8l2.l33 carjacking; or section 8l2.l35 home-invasion robbery shall submit to the Court a cheek swab specimen for DNA cataloging. • This requirement shall be carried out pursuant to the following procedure: l. • State Attorney shall access the database maintained by the Florida Department of Law Enforcement to determine whether the defendant has previously provided a DNA sample pursuant to section 943.325. • 2. lf no sample is recorded, the defendant, while in the courtroom, shall be presented with a Florida Department of Law Enforcement biological collection kit. • The defendant shall be responsible for conducting his or her own cheek swab. • The bailiff shall supervise the collection process, and shall package the completed kit for mailing. • The completed kits shall be maintained in the courthouse, in the offices of the J SO officer in charge of the Duval County Courthouse, pending transmittal to the FDLE laboratory in -- 1 of 3 -- • The completed kits shall be packaged together at least weekly and transmitted to the § FDLE laboratory facility by United States Mail. • The above procedure shall commence on Wednesday, April 3, 2002. • Effective July 1, 2002, and contingent upon specific appropriation, the following offenses shall be added to those enumerated in section 943.325, Florida Statutes: section 8l2.l3 robbery; and section 8l2.l3l robbery by sudden snatching; • Effective July l, 2003, and contingent upon specific appropriation, the following offenses shall be added to those enumerated in section 943.325, Florida Statutes: chapter 787 kidnaping, false • Effective July l, 2004, and contingent upon specific appropriation, the following offenses shall be added to those enumerated in section 943.325, Florida Statutes: any forcible felony as described in section 776.08: treason, murder, manslaughter, sexual battery, carjacking, home-invasion robbery, robbery, burglary, arson, kidnaping, aggravated assault, aggravated battery, aggravated stalking, aircrafi piracy, unlawful throwing, placing, or discharging ofa destructive device or bomb, and any other felony involving the use or threat of physical force or violence against any individual. • Effective July l, 2005, and contingent upon specific appropriation, any felony offense shall be subject to the DNA collection requirement; • That this Administrative Order shall take effect immediately and remain in effect until further Order ofthe Court, and all terms and conditions set forth in this Administrative Order shall apply unless otherwise ordered bythe Court; • That this Administrative Order shall be recorded in the Official Records of Duval County in the State of Florida, and copies furnished by the Clerk of Court and the Jacksonville Bar Association.
