Verbatim from Fourth Circuit administrative order 2021-12 as published by the Duval County Clerk, harvested 2026-07-26; whitespace normalised only. • The Clerk of Court's computerized case management system shall, upon case creation, programmatically randomly and equitably assign the division of a felony case. • Homicide and traffic homicide cases shall be randomly and equitably assigned in a different algorithm from regular division assignments. • Whenever a defendant is arrested, the following program shall be activated and a felony division assigned to the case accordingly, except in regard to a homicide or traffic homicide case. a. • If the defendant has other pending cases, the following reassignment procedure shall be utilized: i. • If there is a pending filed felony case, the filed case takes precedence, and all subsequent cases involving said defendant shall be assigned to the division that has the lowest Clerk’s case number. • When such a pending filed felony case exists, the Office of the State Attorney shall notify the • If there are no pending filed cases, but other pending probable cause arrest cases wherein charges have not yet been filed, the new case shall be assigned to the division that has the lowest Clerk’s case number. iii. • Detention Facility, the jail-related case shall be assigned to the division with the pending case. • If the case involves co-defendants, all related cases shall be assigned to the division that has the lowest Clerk’s case number. • If there is no filed case number, then the case shall be assigned to the division with the lowest arrest docket number. • When a judge places a defendant on probation and that defendant, while on probation, is arrested on new felony charges, the case, regardless of the date of offense, shall be assigned to the felony division that placed the defendant on probation. • When co-defendants are involved, each on probation, the new cases shall be assigned to the division that has the lowest Clerk’s case number on the original felony charge for which the probation was violated. • If the defendant is placed in a diversion program by the State Attorney, and the case is thereafter filed, the case shall thereafter remain assigned to the original division. • If a defendant is arrested on new felony charges while the diversion case is still in diversion status, the new arrest shall be assigned to the division to which the diversion was originally assigned. • If at any time a case has an existing felony division assignment and is dismissed for any reason (i.e., nolle prosequi, dismissal, failure to file charges) and is later activated, the case shall be reinstated to the original felony division. • When a defendant is arrested for a new homicide or traffic homicide case, the following progiam shall be activated and a felony division assigned to the case accordingly. 2of4 -- 2 of 4 -- • All homicide cases, as described in Chapter 782, Florida Statutes, which include first degree murder, second degree murder, third degree murder and manslaughter, shall be randomly assigned to a felony division. b. • Once a defendant is arrested on a homicide case, that homicide case shall be assigned pursuant to the random assignment described above. • All pending cases against the homicide defendant(s), including probation, diverted, or other pending cases, and co-defendants with related cases, shall be transferred to the division to which the homicide case has been assigned. • This Administrative Order shall be recorded by the Clerk of Court, in the Official Records of Duval County, in the State of Florida, and shall take effect immediately and remain in full force and effect unless and until otherwise ordered by the Court.
