' (C) If the camera person or photographer has previously been convicted of contempt for disruptive activity in court or interferes with the dignity of the judicial process and the rights of those who appear before the Court, he or she must report this to the presiding Judge in order to operate a camera in the courtroom. - • If the room is locked,- the media representatives must notify courthouse security. • Prior Arrangements and Agproval (A) Media Representatives must notify the presiding Judge prior to the proceeding they wish to cover via video, audio, or photographic means. ' (B) When equipment must beinstalled in a courtroom, prior arrangements must be - 3 -- 3 of 12 -- coordinated with the Trial Court Administrator and the Jacksonville Sheriff’ s • Office’s (J SO) Courthouse Security Manager or their designee in Duval County or with the Administrative Judge in Clay or Nassau County at least two (2) business days before the court proceeding, unless prohibitive because of an emergency hearing or otherwise lacking sufficient notice to permit timely ~- A---compliance.» ~ - (C) Cable lay out and placement, if any, shall be at the direction of the Trial Court • Administrative Judge in Clay or Nassau County, and shall not present a safety or security hazard. p (D) Live streaming from any courtroom shall occur through a “pooled” camera to all _ media who wish to receive the live stream. • A media representative shall notify the presiding judge at least 24 hours prior to the court proceeding of the intent to live stream the proceedings unless prohibitive because an emergency hearing or otherwise lacking sufficient notice to permit timely compliance. • (E) Any “pooling” arrangements among the media shall be the sole responsibility of the media. • In the absence of advance media agreement on disputed equipment or personnel issues, the presiding Judge shall exclude all equipment belonging to the contesting media representatives from the proceeding. • Judge in Clay or Nassau County, shall designate a specified number and location of seats in the public area of the courtroom for the following groups: • It shall be the affirmative duty of media personnel to demonstrate to the presiding judge adequately in advance of any proceeding that the equipment sought to be used meets the sound and light criteria as enunciated in this Order. • A failure to obtain advance judicial approval for equipment shall preclude its use in any proceeding. • Not more than one (1) audio and video device for recording and/or live streaming, operated by not more than one (1) media representative, shall be permitted in any court proceeding. • Not more than one (1) still photographer using not more than two still cameras, shall be permitted in any court proceeding. • Although one video, audio, or photographic recording device is allowed, any request for additional cameras or other media equipment must be presented to the presiding judge no later than two (2) business days before the court proceeding intended to be covered by the media, unless prohibited because of an emergency hearing or otherwise lacking sufficient notice to permit timely compliance. • Microphones and related wiring essential for media purposes, if any, shall be unobtrusive and shall be located in places designated in advance of any proceeding by the Chief Judge in Duval County or (b) the Administrative Judge in • The position of the pooling camera in the courtroom shall be approved by the presiding judge or staff designated by the presiding judge. • The use of cell phone cameras or any other photographic or recording device by non-media persons is prohibited. • While court is in session, cell phones shall not be used for telephone calls. • All cell phones, pagers, and electronic devices must be turned off or switched to silent mode. • If media equipment of any kind or sortdamages the courthouse or any of its furnishings, it shall be the sole responsibility of the media organization that . 5 -- 5 of 12 -- caused the damage to pay for the appropriate repair. • Only television, photographic, audio, and electronic equipment that does not produce distracting sound or light shall be used to cover court proceedings. • Media representatives using laptop computers or any other electronic devices to provide coverage through intemet or social media websites shall ensure such laptop computers or electronic devices do not produce any noise when in use. • Silence is required to ensure such coverage does not distract the jury, lawyers, or courtroom staff from the proceedings. • No artificial lighting device of any kind shall be used in connection with the television camera. • It shall be the affirmative duty of media personnel to ensure that the equipment sought to be used meets the sound and light criteria. • As soon as the proceedings end or the Court goes into recess, in other words, when the Court is no longer in session, all audio equipment must be turned off immediately and remain off until .court proceedings resume. • Television camera equipment shall be positioned in the courtroom or at the courthouse as designated by (a) the Chief Judge, in consultation with presiding judge in Duval County or (b) the Administrative Judge in Clay or Nassau County. • The area designated shall provide reasonable access to coverage. • If and when areas remote from the courthouse that permit reasonable access to coverage are provided, all television cameras and audio equipment shall be positioned only in such areas.
