Verbatim from the order, fetched live 2026-08-03; whitespace normalised only. • If, in response to the Office of the State Attorney’s Notice of Issuance of Investigative Subpoena for Medical Records under section 395.3025(4)(d), Florida Statutes, an individual or their attorney serves a written objection to the subpoena to the State Attorney’s Office, a hearing regarding the investigative subpoena must take place (“Hunter Hearing”). • To assign the matter to a judge and set the matter for a hearing, a case number must be created and assigned. • The Clerk must provide the State Attorney’s Office with the case number assigned to the matter. • The State Attorney’s Office must contact the County Administrative Judge’s office and provide the case number. • If the matter must be reassigned to another judge, the County Administrative Judge will issue an Order of Reassignment to the judge who will preside over the hearing. • To schedule the Hunter Hearing, the State Attorney’s Office must contact the assigned judge’s office. • If the Notice of Issuance of Investigative Subpoena for Medical Records is issued within an existing case, the procedures outlined herein do not apply.
