Verbatim from https://ninthcircuit.org/sites/default/files/AO2021-02.pdf, harvested 2026-07-25; whitespace normalised only. • WHEREAS, pursuant to the Chief Judge's constitutional and statutory responsibility for administrative supervision of the courts within the circuit and considering available resources, to create and maintain an organization capable of effecting the effrcient, prompt, and proper administration of justice for the citizens of this State, the Chief Judge is required to exercise direction, see F1a. • However, if cunently charged with or previously convicted oi resisting officer with violence or battery on a law enforcement officer, victim input is required prior to qualifying for the Program. • Any accused released into this Program shall comply with the following conditions of release: a. • If an accused person released under this Program violates any condition ofrelease, or is arrested for a crime for which probable cause has been found, the Program shall inform the judge assigned to the Post-Booking Mental Health Jail Diversion docket. • If at any time the accused does not wish to participate in the Program, the supervising community corrections officer shall apply to the judge assigned to the Post-Booking Mental Health Jail Diversion docket for a capias to retum the accused to the normal channels for bond and prosecution. • Upon the filing of an Information, the prosecuting agency shall inform the judge who is assigned to the Post Booking Mental Health Jail Diversion docket. • This Order shall remain in full force and effect until further order of the Court.
