From November 13, 2025 all motions for summary judgment filed in the 288th are heard in the 288th rather than Presiding Court; motions already set in Presiding must be reset in the 288th after all parties confer on mutual availability and obtain an approved date from the clerk by e-mail, and settings made without prior approval may not be honored (the court sets its own submission date otherwise); for motions filed on or after December 4, 2025 the § 23.303(a) 60-day setting deadline is strictly enforced; MSJs are heard in the afternoons, never at 8:30 a.m., and by submission unless a hearing is requested.
Applies to motions for summary judgment in the 288th District Court of Bexar County (Judge Cynthia Marie Chapa; clerk Stephanie Martinez). Texas Government Code § 23.303 (effective December 4, 2025) requires motions for summary judgment to be set for hearing or submission within 60 days of filing (90 with good cause or the movant's consent) and ruled on within 90 days of hearing; the Bexar County civil district courts moved MSJs from the Presiding Court to the originating court in response, each publishing its own procedure. Dear Counsel and Pro Se Litigants, Pursuant to recent statutory changes under Texas Government Code Section 23.303(a), the Civil District Courts have implemented new procedures regarding the hearing of Motions for Summary Judgment. Effective November 13, 2025, all Motions for Summary Judgment filed in the 288th District Court will be heard in the 288th District Court, rather than in the Presiding District Court. If you are receiving this email, it is because you currently have a Motion for Summary Judgment set in Presiding District Court. You are required to reset your hearing into the 288th District Court. Before doing so, all parties must confer and make best efforts to agree on dates of mutual availability, and then contact my clerk, Stephanie Martinez, via email at Stephanie.Martinez4@bexar.org, to obtain an approved date based on the court’s availability. All settings must be confirmed with the clerk before a notice of hearing is filed. Settings made without prior court approval may not be honored. If you do not set a date with the court the court will set its own date for submission. Please be advised that under Texas Government Code Section 23.303(a), for all motions filed on or after December 4, 2025, the court must set the motion for hearing no later than the 60th day after the motion is filed unless certain exceptions apply. These statutory deadlines will be strictly enforced. Your cooperation in following these procedures is appreciated. Please be advised that Motions for Summary Judgment will be heard in the afternoons based on your time announcement. MSJs will not be heard at 8:30 in the morning. MSJs will be heard by submission unless a hearing is requested the parties.
