Extension for Good Cause: Hearings may be set within 90 days if the court’s docket requires a later hearing on a showing of good cause or the movant consents. Withdrawn Motions: The timeline is paused if the motion is withdrawn and refiled. Ruling Deadline: Courts must rule within 90 days of the hearing or submission If you have a Motion for Summary Judgement styled within the 73rd District Court, these are the procedures in place. 1. Upon filing your Motion for Summary Judgment, the 73rd District Clerk of Court will set your hearing based on the court’s calendar. a. The Court strives to set within the 60-day timeframe from the filing of your Motion. b. All motions will be set at 4:30pm. c. Please review your Motion for Summary Judgment, as well as the Court’sfiling so that you can ensure which day the Court set your Motion. 2. All Motions for Summary Judgment will be heard by submission. 3. If you require an in-person or ZOOM hearing, please contact the 73rd District Clerk for available dates within the statutorily required deadlines for the hearing to be held. a. Confer with your Opposing Counsel to select a date. b. File your Notice of Hearing with your selected date. c. Within your Notice of Hearing, explain how much time you need and why. d. The Court will review the request and set appropriately. e. If the Court denies your request, you will keep the original submission date. 4. Parties are to continue to follow the Texas Rules of Civil Procedure regarding filing responses or amendments.
