Administrative Order 2026-1 appoints a Court Investigator in ALL guardianship matters pending in the Brazos County Courts at Law to investigate the condition and circumstances of every ward/proposed ward: the investigator provides the order and applicable pleadings to the ward and meets with them, investigates whether the person is incapacitated and whether a guardianship is necessary; the ward may petition to set aside the appointment (Estates Code sec. 1102.001(b)(1)) where an Information Letter is on file; and (Estates Code sec. 1054.152(3) + HIPAA 45 CFR 164.512(e)(1)(i)) any covered entity must give the investigator complete, immediate access to the ward’s protected health information.
