CCL No. 2's court-approved remote-plea protocol for time-served or fine-only misdemeanor resolutions, run through the DA's Adobe e-signature packet: an 18-step sequence from defense-DA agreement through document assembly, defendant e-signature, in-person fingerprinting at the Courts Building security station, DA final signature, coordinator review, and a scheduled WebEx video plea — with the scheduling deadline of 11:30 a.m. the day before the hearing and no hearing scheduled until the coordinator has every document.
Texas > Ellis County > County Court at Law No. 2 — misdemeanor pleas resolving to time served or a fine only, by agreement (CCL No. 2 holds approximately one-half of Ellis County misdemeanors under Court Rules of Administration § VI). Revised 5/21/20 and still posted by the court; the protocol is unsigned in the document itself.
"The District Attorney has converted the plea forms to an Adobe format that will facilitate electronic transmission of documents, electronic signatures, and remote resolution of some cases. The following procedures have been discussed and approved by the Court and the County/District Attorney's office:" (1) defense counsel contacts the assistant DA confirming an agreement and its details; (2) the DA prepares all documents; (3) the DA sends the plea documents electronically to defense counsel for review; (4) the DA sends the fingerprint form to the Sheriff's desk at the Courts Building security station; (5)–(8) defense counsel reviews and signs, the Adobe tracking system routes the packet for the defendant's signature, counsel reviews the documents with the defendant, and the signed packet returns to the DA automatically; (9)–(11) the defendant brings identification to the Courts Building, is fingerprinted by a Sheriff's deputy at the front security station, the deputy files the print with the County Clerk and notifies the DA, and the defendant notifies defense counsel; (12) "DA will review and confirm all documents, including fingerprint, are complete, and then, and only then, DA will sign"; (13) documents forwarded to the Court Coordinator for review; (14) the parties contact the Court Coordinator to schedule the WebEx video conference; (15) "The deadline for scheduling a hearing is 11:30 a.m. on the day before the scheduled hearing date (no hearing will be scheduled unless all documents have been received by the Court Coordinator)"; (16) all parties including the defendant attend the video conference with video and audio; (17) at the conclusion the defendant is instructed on payment of fines and costs; (18) the defendant and counsel comply with any further steps the Court directs to conclude the matter.
