JURY TRIAL PREPARATION ORDER (TRCP Rule 166). Objection to the Associate Judge presiding at the jury trial should be made before the start of the Pretrial Conference; to proceed before the Associate Judge, objection must be waived in writing prior to the conference. All items below SHALL be exchanged, filed, and completed at least three days before the Pretrial Conference, with copies brought to the conference: (1) party/attorney list; (2) statement of agreed and contested issues; (3) witness list — witnesses not properly listed will not be allowed to testify, except rebuttal witnesses whose testimony could not reasonably be anticipated; (4) exhibit list — all exhibits pre-marked and ready for admission with inadmissible matter redacted; authenticity objections SHALL be made at the Pretrial Conference or are waived; unlisted exhibits will not be admitted except for good cause; (5) draft jury charge (Word format to 328th@fortbendcountytx.gov); (6) deposition excerpts with page/line designations — objections at the conference or waived; (7) motions in limine, ruled on at the conference; (8) Daubert/Robinson motions filed and set for hearing at the conference — failure to comply is waiver; (9) trial-length statement with conflicts.
