The following procedures shall be followed when any Application for the Appointment of a Guardian, Successor Guardian, or Temporary Guardian is filed in the Fort Bend County Courts at Law: (a) the Criminal History Records Request Form prepared by the person(s) governed by Estates Code § 1104.408 shall be filed with any such application; (b) if the form is not filed, or a proposed guardian fails to provide a criminal history record pursuant to § 1104.403, no hearing on the application shall be placed on the calendar of the County Court at Law having probate jurisdiction until the form has been filed with the County Clerk and/or a criminal history record has been provided; (c) the County Clerk shall submit the criminal history record of the proposed guardian to the court via in camera inspection. The clerk obtains criminal history record information per Estates Code § 1104.402 and may charge a $10 fee. Signed November 17, 2015 by the judges of County Courts at Law Nos. 1-4.
