Effective April 19, 2023, unfiled misdemeanor criminal matters — matters after arrest but before the District Attorney files a complaint and information — shall remain with the magistrate who originally acted on the matter; if that magistrate is unavailable, the matter shall be heard by the designated County Court Magistrate or Associate Judge, and if unavailable, by any District Court Magistrate or Associate Judge; magistrates and associate judges are granted authority to hear such unfiled matters; rescheduling of first appearances rests in the discretion of the county court to which the matter is assigned. Approved by the Council of Judges April 19, 2023 (Local Administrative District Judge signature); filed April 26, 2023.
