Guadalupe County Administrative Order No. 2019-1 — Requiring the Use of the Court's Approved Form for Small Estate Affidavits. The Probate Court finds a need for an administrative order regarding the form to be used when a Small Estate Affidavit is filed in the Guadalupe County Probate Court under Texas Estates Code Chapter 205, noting that over half of the Small Estate Affidavits filed do not provide all information the Code and Court require, and that while approval is within the Court's discretion (Estates Code sec. 205.003), evaluating incomplete affidavits wastes the resources of the Court and applicants. The Court has created a Small Estate Affidavit form that, if completely and correctly filled out, includes all information necessary to determine whether the affidavit should be approved, posted on the probate page of the Court's website. IT IS ORDERED that the Guadalupe County Probate Court will not approve any Small Estate Affidavit unless it uses the approved form posted on the Court's website (or a future posted modification).
