Standing Order Establishing the General Authority and Scope of the Guardianship Staff Attorney as Court Visitor in Guardianship Cases Within Hays County (County Courts at Law). To ensure the effective administration of guardianship proceedings and provide the Courts with accurate, independent and timely information necessary to protect incapacitated persons, the County Courts at Law establish the authority and scope of the Guardianship Staff Attorney to serve as Court Visitor. Pursuant to the Texas Estates Code, including Chapters 1054 and 1102, the Guardianship Staff Attorney is authorized to act as an agent of the Court for the limited purpose of conducting visits, reviewing records, interviewing proposed wards, current wards, guardians and other relevant persons, and submitting written reports and recommendations directly to the Courts; when acting as Court Visitor the Guardianship Staff Attorney shall not serve as an advocate for any party but shall function solely as a neutral extension of the Court to assist in determining the best interests of wards and proposed wards, with the further authority and responsibilities granted in the order.
