Felony cases: $90.00 per hour for trials and contested dispositions; plea or dismissal $600 (state jail or 3rd degree), $750 (2nd degree), $1,000 (1st degree), $150 for each additional case to a $1,200 maximum; motions to revoke $500 plus $150 per additional case to $1,200; appeals $2,000 (jury) or $1,500 (nonjury) for a single case, $2,500 or $2,000 for multiple cases, $10,000 for a capital case; death-penalty lead counsel $125 per hour and second chair $100 per hour, each to a $75,000 maximum. Misdemeanor cases: fixed rates of $100 (dismissal), $350 (plea and sentence), $250 (probation revocation), appeals $350 to $1,000, plus $50 per additional case to $600; daily rates of $350 (non-jury) and $500 (jury) premised on six hours in court; hourly rates of $40 to $75 when approved, claimed to the nearest tenth of an hour with an itemized statement; expenses, with prior written court approval for investigators or experts; payment requests at disposition or within five working days after a trial, one form for all of a defendant's cases. Juvenile cases: $350 per adjudication hearing. DFPS cases: $100 per hour. Vouchers for appointments made through the indigent defense software are submitted through it.

Leon County Court Attorney Fee Schedule For Appointed Counsel FEE SCHEDULE The county will pay appointed counsel for all time reasonably necessary for adequate representation of the parties to whom indigent defense counsel is approved by a judge, according to the following fee schedules adopted by the Judges of Leon County. There are four (4) separate schedules combined in this document. Please use the appropriate section. If the attorney is appointed through an indigent defense software program such as TechShare, the attorney fee voucher should be submitted through same. At this point, only criminal felony and misdemeanor cases are appointed through an indigent defense software program. FELONY CRIMINAL CASES 1. Appointed attorneys shall be compensated according to the following schedule: a. Trial: For the trial of criminal cases whether to a jury or the court, and including contested disposition hearings such as motion to revoke, appointed attorneys shall be paid $90.00 per hour for all documented out-of-court and in-court time that is already spent on the case that reasonable professionals would agree was reasonably necessary for a qualified criminal defense attorney to represent the client with a minimum amount equal to the scheduled amounts for disposition by plea or dismissal. b. Disposition: Felony cases: Single case: $600 for plea/dismissal of a state jail or 3rd degree felony, $750 for plea/dismissal of a 2nd degree felony, $1,000 for plea/dismissal of a 1st degree felony. Additional cases: $150 for plea/dismissal for each additional case, on the same defendant, up to a total maximum for all cases, on the same defendant, of $1,200.00 Motion to revoke or proceed: $500 for plea/dismissal of a single case, and $150 for plea/dismissal for each additional case, on the same defendant, up to a maximum for all cases, on the same defendant of $1,200. c. Appeal: Felony: $2,000 for appeal of a single case tried to a jury. $1,500 for Nonjury, $2,500 for appeal of multiple cases on the same defendant tried to a jury. $2,000 nonjury, $10,000 for appeal of a capital death penalty case. d. Death Penalty Capital Cases: Lead Counsel; $125 per hour with a maximum total of $75,000.00; Second Chair; $100.00 per hour with a maximum total of $75,000.00 MISDEMEANOR CRIMINAL CASES FIXED RATES These fees will be the standard compensation for the following services: Case dismissed prior to or after criminal information filed: $100 Plea and Sentence (separate setting)*: $350 Probation Revocation Hearings: $250 Appeals: (see below) Single case nonjury: $350 Single case tried by a jury: $500 Multiple cases on the same defendant nonjury: $750 Multiple cases on the same defendant tried by a jury: $1000 *Add $50 for plea/dismissal for each additional case on the same defendant, up to a total maximum of all cases, on the same defendant, of $600 DAILY RATES Daily rates are premised on a minimum of six hours spent in court. If less time is spent the fee will be reduced. The Daily Rate Fee includes compensation for preparation time. Non-Jury Trial: $350 Jury Trail: $500 HOURLY RATES (Minimum $40 per hour—Maximum $75 per hour) When a fixed rate is provided above an hourly rate claim will ordinarily not be approved. Claims for payment should reflect the time expended to nearest 1/10th of an hour. If an hourly rate is approved, an itemized statement reflecting the date, service performed, and time expended, must be submitted with the request for payment form. EXPENSES Court appointed counsel will be compensated for all reasonable and necessary expenses: I.e., collect or long distance phone calls, copying expenses, auto mileage (at State rate). All major expenses, such as investigators or expert witnesses, will require written approval by the court prior to the expense being incurred. REQUEST FOR PAYMENTS 1. Request for payment forms shall be submitted at the time the case is disposed of except for trails. Requests for payment after the trails should be submitted within five working days of the conclusion of the case. 2. If a case is disposed of prior to the filing of criminal information or is a writ matter, the request for payment from should be submitted to the Judge who signed the attorney appointment order. 3. Payment for all of a defendant's cases should be requested on one form. 4. Payment for expenses such as investigators and expert witnesses should be requested on a separate form. JUVENILE CASES Single case: $350 for adjudication hearing of single case DEPARTMENT OF FAMILY PROTECTIVE SERVICES CASES Hourly rate: $100 per hour, documented in-court and out-of-court time, for the representation of DFPS parties.
