For non-moving violations, a court clerk MAY NOT process a request for deferred disposition (at the window or by mail, fax or email plea) where, in addition to the standard conditions, the offense involves Alcoholic Beverage Code ch. 106, Health & Safety Code ch. 161 (tobacco), or Penal Code ch. 22 (assaultive) or ch. 31 (theft). For "Failure to Provide Proof of Financial Responsibility" and "Driving While License Invalid," a clerk MAY process a deferred request if the defendant meets the standard conditions (pay in full at the time of the request, or enter a pay agreement to pay court costs and the special-expense fee in three equal payments within the first 60 days of probation); the deferral period is 90 days, during which the defendant MUST NOT receive another such non-moving-violation offense, and a sworn affidavit to that effect is required after the 90-day probation period.
